Executor and/or Trustee of Wills

The importance of making a Will cannot be over-emphasised. Without a Will, which sets out in legal form your wishes as to the distribution of your property, it is unlikely that your wealth will pass to the members of your family and others as you would wish.

The appointment of our Company as executor will ensure that the wishes of the testator will be carried out effectively. Where there are ongoing trusts established by the Will or children who are not of full age, our Company will continue to act as trustee until such time as all assets have been properly administered.

Administration of Estates

Where there has been a failure to make a Will, our Company can still be of great assistance to the family by being appointed administrator of the estate. This can not only ease the burden of the administration falling upon individual members of the family, but can also simplify the formalities required by the Court in issuing a grant of administration and avoid the expense of an administration bond. Our Company can also act in cases where there is a Will, but the executor named in the Will does not wish to accept the burden and responsibility of being an executor, or would like our Company to take over responsibility for the work involved.

Attorney Administrator for Overseas Estates

We accept appointment by way of Power of Attorney to handle assets in Hong Kong belonging to foreign estates. In most cases we will be responsible for the collection and realisation of the assets in Hong Kong, and remitting or transferring them to the principal executors or trustees outside Hong Kong, to be administered with the rest of the estate.

Trustee of Family or Other Trusts and Settlements

There are times when individuals wish to create a trust or settlement to benefit members of their family, or to establish a trust or settlement to promote some worthwhile causes. Our Company is able to advise and assist persons and their advisors in such circumstances. Often, great savings in taxation and estate and inheritance duties can be achieved by the use of discretionary and other trusts.

Where a person is not in Hong Kong or is about to leave Hong Kong, it is possible for our Company as trustee to manage the property and assets situated in Hong Kong. With such an appointment, our clients can rest assured that their assets will be well managed and protected while they are abroad.

Provident Funds, Investment Funds and Unit Trusts

Our Company has sound experience acting as trustee of all of the above specialised trusts, and is able to provide professional advice to clients.

Trustee for Charities and Public Funds

The volume of work in looking after the records and affairs of charities and public funds can be considerable. It is usually not worthwhile to establish a separate organisation for this purpose, as it would be very expensive. Our Company is well equipped to handle such matters and can assume the burden of administration and management.

Trustees for Capital Market Issues

Hong Kong is a sophisticated financial centre, with a well-developed capital market. Most issues require the services of a trustee. In such cases, it is important that the trustee acts independently and be informed by a good business and general knowledge of Hong Kong and the region.
